THE Padawan Municipal Council (MPP) has been urged to stop its councillors from acting on those who complain about issues and instead to resolve them.
Sarawak DAP chief Chong Chieng Jen said in a statement that there was an issue of drain design that has affected a resident in Jalan Semaba.
He said the drainage design that was approved by MPP has allowed water from the concrete drains to be discharged through the natural earth drain along a plot of land.
“This had caused severe soil erosion along the boundary of Lot 161A, and caused the sinking of the concrete slab adjacent to the earth drain and the building structure.”
He said that for several years, the landowner had approached MPP to resolve the problem but to no avail.
He added that the soil erosion and land sinkage problem and building damage was worsening.
“Finally two weeks ago, the landowner approached me to write on her behalf to request MPP to construct a concrete drain along the natural earth drain to prevent further erosion to her land.
But Chong claimed that instead of replying to his letter, a councillor called up the landowner, scolded her and even threatened to cancel the project.
“Councils collect assessment rates from landowners and house owners and to provide a proper drainage system is one of its basic responsibilities.”
He said the landowner has lived there for more than 40 years and dutifully paid the assessment rates to the Council.
“The excuse of council’s money cannot be used to repair private property is not valid as the damage was caused by improper and irresponsible act of the council in allowing excess water from its drains to be discharged through a private drain.”
Chong said this was the basic law of torts and urged MPP to quickly remedy the situation by constructing a concrete drain over the earth.
He said MPP should also stop bullying and terrorising the aged landowner.
